IMPORTANT INFORMATION REGARDING THE USE OF MEGATECH RC PRODUCTS:
Megatech Radio Control products are designed to the highest specifications. Some require practice and learning skills to achieve expert flight times and to be able to perform stunts. If you have never flown an RC item before, we recommend you consider carefully any purchase beyond the beginner level. Megatech's products are designed with replaceable parts, so even if you do have the unfortunate crash, in most cases, only a few dollars in replacement parts will have you back in the air again.
Megatech and Zearth.com are not liable for damages to a Megatech RC toy due to crash, user negligence, or user error, nor are such damages covered under product warranty. If you don’t understand the product instructions you receive, or if you have questions about operating the product you ordered, please contact the Megatech Service Center before attempting to operate it. Megatech offers FREE flying lessons on all of its items, simply by calling 1-800-MEGA911. In addition, please call the Megatech Service Center if you need return or repair instructions. Crash damage: Any damage to a Megatech RC toy after which the toy will no longer function according to performance design parameters is considered “crash damage” and is not covered under product warranty. Megatech and Zearth.com also are not liable for any damage to the toy surface, including dents, scratches, etc., that are incurred during a crash.
Any landing of a RC aircraft is considered a “controlled crash.” Users performing aircraft landings are liable for any damage sustained to the aircraft. Though all aircraft have been designed to withstand a certain amount of landing stress, any hard or fast landing can result in serious damage. It is recommended that only expert flyers attempt take-offs or landings on cement or asphalt surfaces. It is recommended that you use a large field with grass to cushion landings.
Damages sustained after a user has landed any Megatech RC car or truck off a ramp are the owner’s responsibility.
Harsh weather and environmental conditions: Consumers using Megatech toys during harsh weather conditions assume all damage liability. Consumers using Megatech toys on poor surface conditions, such as mud, snow, sand, grass, etc., assume all liability for damage or repair, including dents, scratches, etc.
Megatech RC helium-filled toys: RC Helium-filled toys must be used indoors. Megatech and Zearth.com are not responsible for toys that are lost because they have left the radio transmitter’s range. Megatech and Zearth.com are not responsible for misuse of helium gas or any resulting ill-health effects to the consumer.
RC Racing: Any toy owner who races a Megatech RC product (either on a timed course or against an opponent) waives any and all warranty and return rights. All repair or replacement costs incurred as a result of racing damage will be the purchaser’s responsibility.
Nitro gas-powered toys: Just like any vehicle you drive off a sales lot, once a Megatech product with a nitro (gas-powered) engine has been started and run, it’s considered a "service-only product.” This means it can’t be returned for a refund - only for repairs. You must call the Megatech Service Center for return and repair instructions or for help finding a qualified hobby repair center in your area.
Customers will be responsible for the cost of shipping items to Megatech in need of service or repair. Megatech will pay for shipping repaired items or replacement parts back to customers.
Skill levels required to operate RC toys: For a product’s skill-level usage rating, please refer to the following:
Beginner toy: For any person or child who has never driven, flown, or sailed a RC toy. For any person who has never successfully driven, flown, or sailed a RC toy without incurring serious crash damage as defined as breakage of a critical part such that the toy will no longer function as advertised. For any person or child who has never driven, flown, or sailed a RC toy that is powered by a gas engine. This person can demonstrate basic control of the toy some of the time.
Intermediate toy: For any person or child who has only occasionally driven, flown, or sailed a RC toy. For any person or child who has successfully driven, flown, or sailed a RC toy without causing serious crash damage. This person can demonstrate moderate control over the toy most of the time.
Advanced toy: For any person or child who has frequently driven, flown, or sailed a RC toy and has successfully used such toy without incurring serious crash damage. For any person or child who has successfully used a RC toy remote control unit and can willfully stop, start, and turn a toy in a desired direction and manner. This person can demonstrate complete control over the toy at all times.
RC aircraft: Because of the responsibilities involved in flying gas-powered RC aircraft, Megatech and Zearth.com recommend only those who are 18 and older fly them. All gas- and battery-powered aircraft should be flown in the presence of an experienced adult. Please be aware of local laws pertaining to gas-powered RC aircraft; some areas prohibit their use. All beginner-rated aircraft first should be flown by an adult and successfully landed before the controls are turned over to anyone under 18.
Megatech strongly recommends that those who lack experience with RC aircraft purchase only beginner-rated aircraft and that they read and understand all instructions prior to first flight. If you have any questions whatsoever, please contact Megatech. All actions and movements using the remote control unit should be smooth and purposeful. Practice flying your aircraft in a soft-surface environment, such as a soft grassy field or large carpeted arena. Just like learning to drive a car, start slow and build up speed as you gain experience. All flying stunts, such as dives, aerial barrel rolls, deliberate stalls, etc., should be practiced in the presence of advanced-level RC pilots.
RC helicopters: Flying a RC helicopter takes a certain amount of skill and patience. Megatech recommends reading all instructions and viewing the CD ROM that comes with the helicopters before attempting to fly one. All actions and movements using the remote control unit should be smooth and purposeful. Practice flying your helicopter in a soft-surface environment, such as a soft grassy field or large carpeted room. Do not attempt to fly in harsh weather conditions, such as wind, rain, snow, sleet, hail, or sandstorms. Though all helicopters have been designed to withstand a certain amount of landing stress, any hard or fast landing may result in serious damage.
Missiles and lasers: Megatech toys equipped with launchable missiles or lasers must be used with caution. Megatech and Zearth.com are not liable for injuries or deaths caused by the misuse of missiles or lasers. Megatech and Zearth.com are not liable for the misuse or unlawful use of missile and laser RC toys. Megatech and Zearth.com are not liable for radio interference with emergency broadcasting systems.
Injuries and death: Megatech and Zearth.com are not liable for any accidental or purposeful injuries or deaths caused by the negligent or deliberate use of any RC Toys.
Damage to people and inanimate objects: Megatech and Zearth.com are not responsible for collisions and any resulting damage to any obstacle, living or inanimate, that your toy may encounter. Megatech strongly recommends using your RC product in an approved area. It is recommended that flying aircraft, except for helium toys, be flown in an official RC aircraft park or a large, soft grassy field free of obstacles. It is recommended that surface vehicles be used either inside or in an abandoned street, parking lot, yard, or park. Megatech and Zearth.com are not liable for legal issues pertaining to use in public and private areas. Please consult with your local authorities for information pertaining to usage issues.
